Sales Driver Search Official Rules
1) Candidates must be currently unemployed.
2) Search is open to persons at least18 years of age, legally residing in USA, and eligible for employment in California, Oklahoma, and Nevada. Employees and immediate families of Pole Position Raceway are not eligible
3) Selected candidates will be considered Independent Contractors during the Search, and must sign the Independent Contractor agreement of Pole Position Raceway.
4) Candidates will sell 2010 racing passes at retail price, NO discounts.
5) Candidates will receive a 10% commission on gross sales during the Search. There will be no reimbursements for expenses during the Search. Candidates should have reliable transportation.
6) Candidates shall conduct themselves in a professional manner at all times while representing Pole Position Raceway.
7) Candidates may not make false claims or misrepresent the company’s products/services in any way, and any misrepresentation could lead to disqualification from the Search.
8) Winning candidate(s) will be determined based on the following criteria: a. ales dollars generated b. Creativity c. Effort
9) The winner of this Search will earn a $40,000/year career opportunity** at Pole Position Raceway, or a $5,000 cash prize. Position begins January 4, 2010. Winning candidate(s) will be subject to background check and drug test prior to actual employment with Pole Position Raceway. Career opportunity will be under an At Will employment agreement. Position will be a sales position at Pole Position Raceway. This job will consist primarily of selling group and corporate events and other sales initiatives. Position will be subject to ongoing sales quotas to continue employment; past performance is not a guarantee of future employment. Position will be salary plus commission. Actual starting salary will be determined by results of contest. Actual final pay will also be determined based on commissions earned during the year. Actual salary plus commission may be more or LESS than $40,000.
10) Winning candidate(s) will be required to enter an At Will Employment Agreement with Pole Position Raceway.
11) The candidates may choose to recruit or manage others (friends, distributors, agents, colleagues etc) hereby referred to as affiliates, to achieve results. Those affiliates are held responsible to the ethics and rules of the contest and any violation or misrepresentation by the affiliates may result in the disqualification of the candidate. No compensation will be provided by Pole Position Raceway to anyone other than the
candidate.
12) All Federal, State, and Local laws and regulations apply during Search. All candidates are responsible for reporting and paying taxes on any commissions earned during the Search
13) Winning candidate(s) will be required to enter at At Will Employment Agreement with Pole Position
14) By participating, candidates agree to release, discharge and hold harmless Pole Position Raceway, and each of their respective partners, affiliates, subsidiaries, advertising agencies, agents, and their employees officers, directors and representatives from any claims, losses, and damages arising out of their participation in this Search or and Search-related activities and the acceptance and use, misuse, or possesion of any prize awarded hereunder.
15) Candidates' names, voices, and likeness, may be published by Pole Position Raceway, in magazines on websites, or in any other medium, and/or in press releases associated with the "2010 Sales Driver Search."
16) The California courts will have sole jurisdiction of any controversies regarding the Contest. The laws of the state of California will govern the Contest. By entering the contest, entrants waive any and all objections to jurisdiction and hereby submit to the venue of those courts within California
17) By participating in the Contest, entrants agree to be bound by these Official Rules and the decisions of the Contest judges, which are binding and final
